Public offer agreement on the provision of notarial services
Private notary Korneenkova Nadia Oleksandrivna, acting on the basis of the Certificate of the right to engage in notarial activities No. 8537 dated 06/17/2011, invites any individual or legal entity (hereinafter referred to as the “Client”) to conclude this Public Offer Agreement on the provision of notarial services.
In accordance with Articles 633, 641, 642 of the Civil Code of Ukraine, this document is a public agreement and a public offer.
Acceptance of the terms (acceptance) is:
- submission of documents for the performance of a notarial act;
- appointment for an appointment;
- payment for services;
- actual ordering of any notarial service.
1. Subject of the agreement
1.1. The Notary provides the Client with notarial services in accordance with the Law of Ukraine “On Notarial Services”.
1.2. The list of services includes, but is not limited to, notarial actions specified in Section 8 of this Agreement.
2. Terms of provision of services
2.1. The Client is obliged to provide a package of documents necessary for the performance of the relevant notarial action.
2.2. The Notary has the right to request additional documents or information.
2.3. The Notary may refuse to perform a notarial action in cases provided for in Article 49 of the Law of Ukraine “On Notarial Services”.
2.4. The terms of performance are determined by law or agreement of the parties.
3. Cost of services and payment procedure
3.1. The cost of notarial services consists of:
- state duty (if applicable);
- fee for performing notarial actions;
- payment for additional services of a legal and technical nature.
3.2. The tariffs are set by the Notary in accordance with market conditions and are published in the public domain.
3.3. Payment is made in cash or non-cash.
3.4. The Notary is a self-employed person, services are provided on the basis of subparagraph 14.1.226 of paragraph 14.1 of Article 14 of the Tax Code of Ukraine.
4. Rights and obligations of the parties
4.1. The Notary is obliged to:
- comply with the requirements of the legislation;
- ensure the preservation of notarial secrecy;
- inform the Client about the procedure for performing a notarial act;
- provide high-quality legal and technical services.
4.2. The Notary has the right to:
- request documents;
- refuse to perform an act in cases provided for by law;
- establish tariffs for services.
4.3. The Client is obliged to:
- provide reliable documents;
- make payment;
- comply with the legal requirements of the Notary, the legislation of Ukraine and international law.
5. Confidentiality
5.1. All information received by the Notary is a notarial secret and is not subject to disclosure, except in cases specified by law.
6. Liability of the parties
6.1. The Notary is liable within the limits of the legislation.
6.2. The Client is responsible for the authenticity of the submitted documents.
6.3 The professional activities of the Notary are insured to ensure compensation for damage caused as a result of a notarial act and/or other action entrusted to the Notary in accordance with the Law of Ukraine "On Notarial Service", Part One, Article 28, Insurance of Civil Liability of a Private Notary.
7. Dispute Resolution
7.1. Disputes are resolved through negotiations.
7.2. In case of failure to reach an agreement - in court in accordance with the legislation of Ukraine.
